Guardianship of Minor Children
Making sure your kids are looked after matters.
It’s important to have a plan for who will care for your minor children if you or your spouse were to pass away. Including guardianship provisions in your Will helps ensure your children are looked after by someone you trust, and that their future care is clear and legally supported.
FAQ’S ABOUT GUARDIANSHIP OF MINOR CHILDREN
-
If you have minor children, then you may wish to consider nominating in your Will a guardian (and substitute guardian in the event that your original guardian is unable to act) for your minor children to act in the event that there is no surviving parent.
-
Appointing a guardian in your Will allows you to choose someone you trust to care for your children if you're no longer around. It gives you the chance to outline any specific wishes you’d like them to consider such as your preferences around education, living arrangements, or values that are important to you.
If no guardian is appointed, the Family Court will decide who takes on that role. This can lead to uncertainty, delays, or disputes between family members. Appointing a guardian helps ensure your children are looked after by who you choose.
